Introduction
Welcome to HOSXI. These Terms of Service (“Terms”, “Agreement”) constitute a legally binding agreement between you (“Customer”, “you”, “your”) and HOSXI Ltd, a company registered in England and Wales with its registered office at 71–75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom.
This Agreement governs your access to and use of all HOSXI products and services, including but not limited to web hosting, domain registration, cloud VPS, dedicated servers, reseller hosting, SSL certificates, and website development services (collectively, the “Services”).
By accessing, registering for, or using any HOSXI Service, you confirm that you have read, understood, and agree to be bound by these Terms and all policies incorporated herein by reference, including our Privacy Policy and Acceptable Use Policy.
If you do not agree to these Terms, you must immediately cease using HOSXI services.
Eligibility
To use HOSXI services, you must meet the following eligibility requirements:
- You must be at least 18 years of age, or the age of legal majority in your jurisdiction.
- You must provide accurate, complete, and current information during registration and throughout the term of your account.
- You must have the legal capacity to enter into a binding contract under the laws of England and Wales.
- Businesses must be legally registered and in good standing.
- You are solely responsible for all activity that occurs under your account, including actions taken by any authorised users.
HOSXI reserves the right to verify the identity of any customer and may require additional documentation. Accounts found to have been registered with false information may be suspended or terminated without notice.

Dedicated Servers
Fully dedicated bare-metal servers for maximum performance and control.
Reseller Hosting
White-label hosting infrastructure for agencies and independent resellers.
SSL Certificates
Domain, wildcard, and organisation-validated SSL certificates from trusted CAs.
Domain Registration
Registration, transfer, and management of domain names across major TLDs.
Website Development
Professional web design and development services for businesses.
HOSXI reserves the right to modify, update, suspend, or discontinue any Service at any time with reasonable notice. Where a Service is discontinued, HOSXI will endeavour to provide at least 30 days' written notice to affected customers.
Account Registration
When registering for HOSXI services, you agree to the following account obligations:
- Provide accurate, complete, and up-to-date personal and billing information at all times.
- Maintain the confidentiality of your login credentials, including your username and password.
- Notify HOSXI immediately at support@hosxi.com if you suspect any unauthorised access to your account.
- You are solely responsible for all actions taken under your account, whether authorised or not.
- You may not share, transfer, or sell your account to any third party without written consent from HOSXI.
HOSXI may suspend or terminate accounts that show signs of suspicious activity, credential compromise, or fraudulent behaviour. We may require identity verification before restoring suspended accounts.
Payment & Billing
By using HOSXI services, you agree to our billing policies as set out below:
Pricing
All prices are displayed exclusive of VAT unless otherwise stated. HOSXI reserves the right to change pricing with 30 days' notice. Existing customers on annual plans are protected until their renewal date.
Billing Cycles
Services are billed monthly or annually as selected at checkout. Annual plans are invoiced in full at the start of each billing period.
Auto-Renewal
All subscription services auto-renew at the end of each billing cycle unless cancelled before the renewal date. Renewal reminders are sent 14 days in advance.
Late Payments
Accounts with outstanding balances may be suspended after 7 days. Services will be terminated and data may be permanently deleted after 14 days of non-payment.
30-Day Money-Back Guarantee
Shared hosting and WordPress hosting plans include a 30-day money-back guarantee from the first purchase date. This does not apply to renewals, domain registrations, dedicated servers, VPS, or SSL certificates.
Non-Refundable Services
Domain registrations, domain transfers, dedicated server setup fees, and SSL certificates are non-refundable under any circumstances, including cancellation or termination.
Acceptable Use Policy
You agree to use HOSXI services only for lawful purposes and in compliance with all applicable laws. The following activities are strictly prohibited on all HOSXI infrastructure:
- Hosting, distributing, or transmitting any content that is illegal under UK or international law.
- Distribution of malware, ransomware, spyware, or any other malicious software.
- Conducting phishing attacks, social engineering, or fraudulent activities.
- Sending unsolicited commercial email (spam) or operating bulk mail systems.
- Excessive resource consumption that degrades service quality for other users.
- Unauthorised cryptocurrency mining using HOSXI server resources.
- Hosting or transmitting child sexual abuse material (CSAM) — a serious criminal offence.
- Port scanning, vulnerability probing, or intrusion attempts against any third-party system.
- Operating Tor exit nodes, proxies, or VPN services intended to anonymise illegal activity.
- Copyright infringement, including hosting pirated software, media, or warez sites.
- Defamatory, harassing, or abusive content targeted at individuals or groups.
- Interfering with other customers' services or HOSXI's infrastructure.
HOSXI may suspend or terminate any account found to be in violation of this Acceptable Use Policy, with or without prior notice, depending on the severity of the violation. We reserve the right to report illegal activity to appropriate UK law enforcement and regulatory authorities.
Resource & Fair Use
Shared hosting plans operate within a shared environment. All customers must use resources fairly and within the limits applicable to their plan. Resource limits include:
CPU
Shared hosting accounts must not consume disproportionate CPU time. Sustained high CPU usage may result in throttling or account review.
Memory (RAM)
PHP and application memory limits are enforced per plan. Scripts exceeding memory limits will be terminated automatically.
Bandwidth
Plans with bandwidth allocations are measured monthly. Overages may result in service suspension or additional charges.
Storage
Disk usage is measured against your allocated quota. Backups, email, and database storage all count toward your allocation.
Concurrent Connections
HOSXI may limit concurrent database connections and HTTP connections per account to maintain platform stability.
Inodes (File Count)
Shared hosting accounts are subject to inode limits. Very high file counts can degrade server performance.
HOSXI reserves the right to upgrade, throttle, or migrate accounts that consistently exceed fair-use thresholds. Customers will be notified and offered appropriate plan upgrades before disruptive action is taken where possible.
Backups & Data
Customers are solely responsible for maintaining their own backups. HOSXI strongly recommends that all customers maintain independent, offsite backups of their data at all times.
- HOSXI may provide automated backup functionality for certain hosting plans as a courtesy. The availability, frequency, and retention of such backups are not guaranteed.
- Backups provided by HOSXI should not be treated as the customer's primary backup solution.
- HOSXI accepts no liability for data loss resulting from hardware failure, software errors, security incidents, account termination, or any other cause.
- Data recovery requests may be subject to fees, and successful recovery cannot be guaranteed.
- Customers may request a snapshot or backup export for a fee where technically feasible.
Domain Services
Domain registration and management services are subject to the following additional terms:
- Domain registrations are subject to the policies of the relevant registry and ICANN rules, where applicable.
- WHOIS registrant information must be accurate. Inaccurate WHOIS data may result in domain suspension by the registry.
- Domain registrations are non-refundable once registered, regardless of circumstances.
- Domains not renewed before their expiry date will enter a grace period, after which a redemption fee of up to £80 may apply.
- Following the redemption period, the domain will be deleted and may become available for registration by a third party.
- Domain transfer requests may take 5–7 business days to complete and require an authorisation (EPP) code.
- HOSXI is not responsible for domain names registered or transferred fraudulently using your account credentials.
- Certain premium or country-code TLDs may have additional registry-specific requirements.

HOSXI targets a 99.9% monthly uptime for all managed hosting services. This commitment is subject to the exclusions listed below.

Exclusions from SLA:
- Scheduled maintenance windows (notified in advance via status.hosxi.com).
- Force majeure events including natural disasters, acts of government, or civil unrest.
- Downtime caused by customer actions, including misconfigurations or resource abuse.
- Third-party service outages outside HOSXI's direct control (DNS providers, upstream carriers).
- Security incidents requiring emergency mitigation or server isolation.
SLA credits, where applicable, will be issued as account credits toward future invoices and will not exceed the monthly fee paid for the affected service.
Termination
Termination by HOSXI
HOSXI may suspend or terminate your account and access to services immediately and without prior notice in the following circumstances:
- Non-payment of fees outstanding beyond 14 days.
- Violation of the Acceptable Use Policy or any provision of these Terms.
- Fraudulent account registration or suspected identity theft.
- Receiving a court order, regulatory directive, or law enforcement request.
- Any activity that poses a security threat to HOSXI's infrastructure or other customers.
Termination by Customer
- You may cancel your services at any time by submitting a cancellation request through your client portal or by contacting support@hosxi.com.
- Cancellations take effect at the end of the current billing cycle unless immediate termination is requested.
- Refunds upon cancellation are subject to the refund policy outlined in Section 5.
- Upon cancellation, all data associated with your account may be permanently deleted within 30 days.
HOSXI is not responsible for any data loss resulting from account termination, whether initiated by HOSXI or the customer. Always maintain external backups before requesting cancellation.
Intellectual Property
Customer Content
You retain full ownership of all content, data, and intellectual property that you upload, store, or transmit using HOSXI services. You grant HOSXI a limited, non-exclusive licence to host and process such content solely for the purpose of providing the Services.
HOSXI Platform & Branding
HOSXI Ltd retains all rights, title, and interest in its proprietary platform, codebase, interface designs, trademarks, logos, and brand assets. You may not copy, reproduce, modify, or create derivative works from any HOSXI intellectual property.
Trademark Restrictions
You may not use the HOSXI name, logo, or any similar mark in any context that implies endorsement, partnership, or affiliation without prior written consent from HOSXI Ltd.
Limitation of Liability
To the maximum extent permitted by applicable UK law, HOSXI's liability is limited as follows:
No Indirect Damages
HOSXI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, or loss of goodwill.
Service Interruptions
HOSXI does not warrant that services will be uninterrupted, error-free, or completely secure. You accept that all hosting services carry inherent risks.
Maximum Liability Cap
HOSXI's total aggregate liability to you in connection with these Terms or the Services shall not exceed the total fees paid by you to HOSXI during the 12 months preceding the event giving rise to the claim.
Third-Party Services
HOSXI is not liable for the actions, failures, or content of any third-party service providers, registries, CDN providers, or payment processors.
Nothing in these Terms shall limit or exclude liability for death or personal injury caused by HOSXI's negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by UK law.
Indemnification
You agree to indemnify, defend, and hold harmless HOSXI Ltd, its directors, officers, employees, agents, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to:
- Your breach of these Terms or any HOSXI policy.
- Your use or misuse of HOSXI services.
- Content that you upload, store, or transmit via HOSXI infrastructure.
- Any third-party claim arising from your use of HOSXI services.
- Your violation of any applicable law, regulation, or third-party right.
- Any fraudulent activity conducted from your account.
Governing Law
Governed by the Laws of England and Wales
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
- Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- HOSXI will always attempt to resolve disputes amicably before resorting to legal proceedings.
- If you are a consumer in the EU or EEA, you may also have the right to use the EU Online Dispute Resolution (ODR) platform.
- These Terms do not affect any mandatory statutory rights you may have as a consumer under applicable UK consumer protection law.
Changes to Terms
HOSXI reserves the right to amend or update these Terms of Service at any time. When significant changes are made, we will notify customers through one or more of the following channels:
- A prominent notice on our website at hosxi.com.
- An email notification sent to the primary email address on your account.
- An in-portal notification visible upon your next login.
Your continued use of HOSXI services following the effective date of any updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must cancel your services before the effective date.
